Gordon S. Blair comments on the applicability of French international public order rules in International Succession Matters.

Geoffroy Michaux and Jérémy Leforestier, together with Me Patrice Bonduelle, Notaire in Paris, envision the possible outcomes of the decision rendered by the Paris Court of Appeal on May 11, 2016 in an article published in “Juris classeur – Semaine Juridique – Droit Notarial n°38 – 23 September 2016”.

This decision states that forced heirship rules do not constitute a fundamental principles of French public international order and that forced heirship rules do not apply to transmission of foreign residents’ estates.

The referred decision also debatably constitutes a milestone in regards to the recognition of trusts as foreign legal entities “as such” in France.
