Monaco National Council Has Enacted A New Act On Private International Law on 22 june 2017
The new law sets up a full set of rules on jurisdiction and applicable law as well as recognition and execution of foreign decisions and instruments. It includes specific rules applicable to status of individuals, marriage and matrimonial regime, parent-child relationships and adoption, alimony and maintenance obligations, successions, contractual and non-contractual obligations, as well as provisions relating to the application of the Hague Convention on Trusts.
This long awaited law organizes and completes existing but limited provisions in one sole set of rules. It will significantly impact Monaco nationals and residents on both their personal affairs and businesses containing an international element, but will ensure a high degree of certainty in those matters in line with the rest of European jurisdictions.
